Zen Avenue Property: Unless otherwise agreed upon in a specific Statement of Work or service contract, Zen Avenue retains all rights, title, and interest in our proprietary code, software architectures, custom plugins, and pre-existing digital assets used to deliver the Services.
Our Services may contain links to or integrate with third-party web sites or services that are not owned or controlled by Zen Avenue (such as external marketing platforms or email delivery services). We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
To the maximum extent permitted by applicable law, in no event shall Zen Avenue, its founders, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on our website.
